This liability disclaimer does not apply to cases covered by the stipulations of § 839 of the German Civil Code (Liability in case of breach of official duty). We assume no liability for damage caused by malware transmitted while accessing or downloading data or installing or using software. We warrant that such information is accurate and up to date.
As a service provider, we are responsible for our own content on this website pursuant to § 6 section 1 of the German State Treaty on Media Services and § 7 section 1 of the German Telemedia Act and in accordance with the applicable general law. However, service providers are not obliged to monitor third-party information they transmit or store or to examine them for circumstances that suggest unlawful activities. We pledge to immediately remove such content as soon as we are informed of any violation.
Our online presentation includes links to external third-party websites whose contents we cannot control. By including these links, we merely facilitate access to the use of third-party contents in accordance with § 8 of the German Telemedia Act. We accordingly cannot be held liable for such third-party contents. Any responsibility for the contents of the sites we link to lies with their providers or operators. We reviewed these sites for potential violations of law before including the links, and did not find any unlawful contents. However, we cannot reasonably be expected to continually monitor the contents of the sites we link to in the absence of concrete indications of unlawful activity. We pledge to immediately remove such links as soon as we are informed of any violation of law. Liability for illegal, inaccurate, or incomplete contents and especially for any damage arising from the use or non-use of information provided by third parties rests solely with the providers of the sites in question.

Raffles are held by the Städtische Galerie im Lenbachhaus und Kunstbau, Munich, through its social media accounts.
Our raffles do not involve a business relationship of any kind with Facebook, Instagram, or Twitter and are not sponsored or supported by Facebook, Instagram, or Twitter.
For questions concerning a raffle, contact us at lenbachhaus(at)muenchen.de or via direct message on Facebook, Instagram, or Twitter.
Conditions of participation:
Participation in raffles is governed solely by the stated conditions of participation. By participating in a raffle, entrants expressly accept these conditions of participation. The Städtische Galerie im Lenbachhaus und Kunstbau, Munich, reserves the right to terminate or cancel a raffle at any time.
Eligibility:
All individuals who reside in Germany and are at least eighteen years old at the time of participation are eligible.
Participation:
Individuals participate in a raffle by leaving a comment under the post advertising the raffle. Participation in a raffle implies consent to the publication of the winning participants’ first names through the Lenbachhaus’s social media channels.
Prizes:
Noncash prizes cannot be exchanged for other goods or paid out in cash. Prizes also cannot be assigned to third parties. Prizes are identified or their nature and extent specified in the post advertising the raffle.
Selection of the winners:
Winners are selected at random; winners’ names are drawn blindly from those of all participants.
Drawing and distribution of prizes:
Entrants who meet the conditions of eligibility and participation are entered for the raffle. Entrants can participate only once in any single raffle. Prizes are raffled off among all eligible participants.
The eligibility of entrants is reviewed and the prizes are raffled off on the first workday after the deadline for entry. Winners are notified via direct message on the platform through which they entered. If a winner does not respond to the Lenbachhaus within ten days after notification, we reserve the right to declare the win forfeited and draw a replacement winner.
Data privacy:
To the extent that the Lenbachhaus collects and processes participants’ personal data in connection with a raffle, such data is used solely for the purposes of the raffle and will be deleted promptly after its conclusion.
Other provisions:
Entrants who violate these conditions of participation or attempt to manipulate the proceedings (e.g., by entering the raffle several times using different accounts) may be excluded from participation. If evidence of manipulation is discovered after the fact, we may retroactively revoke the win and demand that the prize be returned.
Participants indemnify Facebook, Instagram, and Twitter from all liability. Raffles are not subject to legal recourse. The law of the Federal Republic of Germany shall apply exclusively. In the event that individual conditions of participation become invalid, the validity of the remaining conditions of participation shall remain unaffected. These conditions of participation may be changed by the Lenbachhaus at any time without separate notification
